"If the law is on your side, pound the law. If the facts are on your side, pound the facts. If neither are on your side, pound the table." You're going to hear a lot of table pounding in this episode out of Branch 70.

I want you to think about something as you listen to this episode. What are the damages? The Branch 70 president compared Rivera's sharing of an election appeal to "yelling 'fire' in a crowded theater." The reason such speech is not protected is because of the obvious harm: loss of revenue, people get trampled, people can get killed. Compare that to the harm Branch 70 has suffered because people who read the appeal might have thought there was only supposed to be one microphone for nominations.

4.5 years of suspensions, for a harm that Branch 70 doesn't even articulate.

Branch 70 in Their Own Words - The Response to Michael Rivera's Conviction Appeal (Part 1 of 2)

This is the other side of the story. Branch 70 prepared a reply to Michael Rivera, and I am going to read every word of it and discuss it with Michael Brasaemle. This is part one of two.

While listening, bear in mind the two statements, written within an election appeal and shown to be false, that have caused all this trouble. To summarize, one is that the Branch President didn't relinquish his microphone to accept his nomination. The other is that there was going to be one microphone for nominations, but there wound up being three.

Again, both of those allegations wound up being false.

Think about the harm those statements caused to the branch in general, and specifically to the members of the election committee. Financial harm? Emotional distress? Loss of work?

Or did nobody care, because they're insignificant accusations.

The Branch makes its case for why Michael Rivera deserves an 18 month suspension for those two statements. Listen and decide for yourself.

Charges Against Michael Rivera

Well, well, well... the shoe is on the other foot! Michael Rivera is a reformer from Branch 70 in San Diego who found himself in the national spotlight (at least among reform-minded podcasters) when he brought charges against NALC President Brian Renfroe; and then brought charges against the entire Executive Council. Michael recently ran for office in his own branch, and found what he believes to be significant deviations from the NALC's published election rules. He brought those issues to light with an election appeal, and published that appeal on social media, along with the appeals of two other members of his branch.

Now, the members of the branch's election committee have brought charges against Michael for that publication. In this episode, we talk about the charges, and how the charges mirror similar charges that Michael Brasaemle and I faced stemming from our own branch election.

The result is that I have been removed from my position as an alternate steward at my station. The branch president is claiming that alternate steward are AUTOMATICALLY removed from their positions when new officers take their positions, but of course, there's nothing to that effect in our bylaws or in the Constitution. The reality is, the president has exercised his authority to remove me. And, of course, I'm fighting back. Letter from a Coward

I got a letter! It was sent to me at my station, anonymously. It was an attempt, by this anonymous person, to discourage Michael, Jonathan, and me from running for office in our upcoming branch election. The letter asked a series of questions (mostly about knowing people's names, which is odd) that the author thought should be considered before we would take office. So that's what Michael and I did. Last night, in the cab of Michael's pickup truck, we went through the entire letter, answering each of the writer's questions. Sorry about the sound quality. It was recorded in the cab of a pickup truck! Although, it probably came out better than recordings in the echo-chamber that is my living room. In any case, it wound up being pretty fun, and it enabled some much needed conversation about how the branch is being run currently.

We don't do this sort of route inspection very often because of TIAREAP, and there's talk that this entire method of route inspections will be phased out completely. Scanner Features Nobody Told You About

In this episode, I will go over some of the newer features in the MDD scanner. There are some useful tools that make the job easier, especially route maintenance. There is one error in the episode (that I know of). I mention that the time clock function is accessible from the sub menu, but I don't know why that's useful. Well, now I know why it's useful. From the Scan Barcodes screen, you can go into Time Clock using the sub menu, do your clock ring, and then it automatically returns you to the Scan Barcodes screen, which saves a few steps.
